    Types of DWI’s in New York

    DWI vs. DWAI in New York

    The primary difference between DWI and DWAI in New York is the amount of intoxication as determined by Blood Alcohol content.  For DWI, the standard is .08% blood alcohol content.  For DWAI you can be charge if your blood alcohol content is between .05 to .07% – which can be as few as two beers depending on your weight!  For DWAI, you can also be charged based on “other evidence of impairment”.

    Aggravated DWI in New York

    In Albany you can be charged with the more severe Aggravated DWI offense if your blood alcohol content is measured at over .18%.  The law makes penalties more severe for these higher level DWI’s, and fines increase as well.  Aggravated DWI is a serious charge that must be defended vigourously.
